Delcorso (Bankruptcy Eastern District Pennsylvania 2007)
An attorney representing a debtor in a Chapter 7 Bankruptcy was sanctioned for having recommended to the debtor that she transfer title to her house from her name alone to herself and her husband right before she filed her bankruptcy. This was viewed as a fraudulent pre-petition transfer, and accordingly, the transfer would be undone by the Chapter 7 Trustee. The only alternative for the debtor was to go into Chapter 13 to deal with the debts that were compromised by the pre-petition fraudulent transfer.
