Nifong Chapter 7 filing
The man who single-handedly coined the phrase that would forever be associated with overzealous prosecutions, “Nifonged”, former Durham County, North Carolina District Attorney, Michael B. Nifong, filed a voluntarily petition under Chapter 7 in United States Bankruptcy Court for the Middle District of North Carolina. Apparently this is the success he reaped from the coinage.
Even though Nifong hopes his finances will not crumble because of his collapsed career, like his road to an unsuccessful prosecution, it appears that his Chapter 7 filing is “presumptively abusive.” Even though his income is severely limited as a result of the loss of his law license, the total family income, including that of his wife, puts him beyond the threshold for filing a Chapter 7 petition. There are suggestions that flaws in the filing and the correction of the same may allow Nifong to continue forward in Chapter 7.
