Damages for loss of trees never intended for use as lumber
The Pennsylvania Superior Court in the case of Christian v. Yanoviak held that damages for loss of trees never intended for use as lumber by a landowner, but cut down by mistake of another, should not be measured by 42 Pa. C.S. § 8310’s measure for conversion of lumber. Instead the Superior Court affirmed the Lower Court’s verdict which based damages on evidence offered by a real estate agent that the value of the land dropped over $20,000.00 because of the loss of the mature trees.
